Welcome to Capiclan Studio ("we", "our", "us"). These Terms of Service constitute a legally binding electronic agreement between you and Capiclan Learning Technologies Pvt. Ltd. By accessing our website, creating an account, or enrolling in our analytical Masterclass courses, you unconditionally agree to comply with and be bound by these terms. If you do not agree, please discontinue platform use immediately.
1. Master Agreement & Platform Access
This electronic contract is generated in accordance with the Information Technology Act, 2000 and the Indian Contract Act, 1872. By completing enrollment or clicking "Accept", you represent that you are at least 18 years of age and possess full legal capacity to enter into binding agreements.
Capiclan grants you a limited, non-exclusive, non-transferable, revocable license to access our educational curriculums, interactive trading cockpits, and analytical setup videos for personal, non-commercial education only.
2. Intellectual Property & Anti-Piracy
Our educational intellectual property represents years of dedicated quantitative research and proprietary algorithm design. We enforce strict legal protections to prevent unauthorized sharing.
2.1. Proprietary Assets
All curriculum lessons, slide decks, quantitative algorithms, PineScript indicators, and analytical models hosted on Capiclan are the exclusive intellectual property of Capiclan Learning Technologies Pvt. Ltd. and mentor Teja Chaitanya. No right, title, or interest is transferred to you upon enrollment.
2.2. Forensic Watermarking
To deter pirated dissemination, every video stream embeds a covert, dynamically generated forensic digital watermark incorporating your unique Student ID, session timestamp, and cryptographic HMAC signature across video pixel frames.
3. User Conduct & Zero-Trust Security
Account credentials are for single-user individual authorization only. You agree to safeguard your credentials and never permit concurrent multi-party logins.
- Concurrent Device Safeguards: Our security architecture actively audits concurrent sessions. Concurrent logins from divergent IP geographies trigger automated security holds.
- Automated Scraping Prohibition: Any crawling, web scraping, API reverse-engineering, or automated extraction of setup parameters is strictly prohibited.
4. Payment Terms, Taxes & GST
All cohort fees are denominated in Indian Rupees (INR) and include applicable Goods & Services Tax (GST 18%) remitted to the Government of India.
Transactions are processed securely through PCI-DSS Level 1 certified payment gateways (Razorpay, Stripe). Official GST tax invoices are automatically dispatched to your registered email address upon successful transaction settlement.
5. Prohibited Conduct & Termination
We reserve the right to suspend or permanently terminate your account without refund if you engage in:
- Circumventing forensic watermarks, DRM controls, or authentication mechanisms.
- Reselling, sub-licensing, or group-buying platform seats or indicator codes.
- Harassing other cohort students, instructors, or community moderators.
6. Limitation of Liability
Capiclan operates strictly as an educational platform. We are not a SEBI-registered Investment Adviser or Portfolio Manager. In no event shall Capiclan, its officers, or instructors be liable for direct, indirect, incidental, or consequential trading losses incurred from financial market decisions. You assume total personal responsibility for your capital allocation.
7. Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, claim, or proceeding arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India.
